Lempriere Harrington Pty Ltd (ABN 99 700 636 424, ACN 700 636 424) is a corporate and commercial advisory practice registered in Victoria (VIC) and based in Melbourne, VIC 3000. In this policy, we, us and our mean Lempriere Harrington Pty Ltd.

This policy explains how we handle personal information. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) contained in that Act. It applies to information collected through this website, by email, and in the course of providing advisory services.

2. What personal information we collect

We collect only the personal information reasonably necessary for our functions and activities. Depending on how you deal with us, that may include:

  • your name, the entity you represent and your role in it;
  • your contact details, including email address and postal address;
  • the content of your enquiry and of correspondence between us;
  • information contained in documents you provide for an engagement, which may include details of directors, shareholders, employees or counterparties; and
  • billing and payment records relating to an engagement.

We do not seek sensitive information as defined in the Privacy Act 1988 (Cth). If sensitive information is contained in material you send us, we will handle it in accordance with the APPs and will not use it for any purpose other than the engagement.

3. How we collect personal information

Wherever it is reasonable and practicable, we collect personal information directly from you — through the enquiry form on this website, by email, in meetings, or in documents you provide for an engagement.

We may also collect personal information from publicly available sources, such as public company and business registers, and from your other advisers where you have asked us to work with them.

4. Why we collect, hold, use and disclose personal information

We collect, hold and use personal information to:

  • respond to your enquiry and assess whether we can take on the engagement;
  • scope, perform and document advisory engagements;
  • communicate with you and your other advisers about a matter;
  • issue invoices and maintain our own accounting and business records; and
  • meet our legal and record-keeping obligations.

We do not use personal information for direct marketing, and we do not sell, rent or trade personal information.

5. This website, cookies and analytics

This website is a static site. It does not set cookies, does not run analytics or advertising scripts, and does not include social media tracking tools. There is no login, and no account or profile is created for you.

The enquiry form on the contact page does not submit information to a server. It opens an email in your own email application, addressed to us, with the details you entered. Nothing you type into the form is stored on this website.

Our hosting provider may automatically record standard technical information when a page is requested, such as the requesting IP address, the time of the request and the page requested. This is generated by the hosting infrastructure for security and reliability purposes and is not used by us to identify individuals.

6. Disclosure of personal information

We may disclose personal information to:

  • your accountant, registered tax agent, licensed financial adviser, solicitor or other advisers, where you have asked us to work with them;
  • counterparties and their advisers in a transaction, to the extent you have instructed us to do so;
  • our own service providers, such as email, document storage and accounting providers, who are bound to protect the information; and
  • a court, tribunal or regulator, where disclosure is required or authorised by law.

7. Overseas disclosure

We aim to keep personal information within Australia. Some of the software providers we rely on for email and document storage may store data on servers located outside Australia. Before disclosing personal information to an overseas recipient, we take steps that are reasonable in the circumstances to ensure the recipient handles it in a way consistent with the Australian Privacy Principles.

8. Security and quality of information

We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. Those steps include restricting access to engagement files, using access-controlled systems, and destroying or de-identifying information we no longer need.

No method of transmitting or storing information is completely secure. Please do not send confidential documents by email until we have confirmed how they should be sent.

We take reasonable steps to ensure the personal information we hold is accurate, up to date, complete, relevant and not misleading. Please tell us if any detail we hold about you changes.

9. How long we keep information

We keep engagement records for as long as necessary for the purpose for which they were collected, and then for as long as we are required to keep them by law or reasonably need them to deal with a claim relating to the engagement. When information is no longer needed for any of those purposes, we destroy it or de-identify it.

10. Accessing and correcting your information

Under APP 12 and APP 13 you may ask for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading.

Write to ceo@lempriereharringtontec.site. We will ask you to verify your identity, and we will respond within a reasonable period. Access is provided free of charge, although we may charge for the reasonable cost of retrieving and supplying large volumes of material. If we refuse access or a correction, we will tell you why in writing and explain how to complain.

11. Complaints

If you believe we have breached the Australian Privacy Principles or mishandled your personal information, please write to ceo@lempriereharringtontec.site with the details. We will acknowledge your complaint, investigate it, and give you a written response.

If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC), which handles privacy complaints under the Privacy Act 1988 (Cth). The OAIC publishes its current complaint process and contact details on its own website.

12. Changes to this policy

We may update this policy from time to time to reflect changes in our practices or in the law. The current version is always the one published on this page, and the date at the top of this page shows when it was last updated.
