5. Enquiries you send us

The enquiry form on the contact page opens an email in your own email application; it does not transmit information to a server operated by us until you send that email. Please do not send confidential or commercially sensitive documents until we have confirmed the engagement and told you how to send them. Personal information you send is handled in accordance with our privacy policy.

6. Availability of the website

We aim to keep this website available and its content current, but we do not promise that it will be uninterrupted, error-free, or free of harmful components. We may change, suspend or withdraw the website or any part of it at any time without notice.

7. Your rights under the Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any right, guarantee, warranty or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law where doing so would be unlawful.

Liability for advisory work is governed by the engagement note for the relevant matter, which prevails over these terms to the extent of any inconsistency.

9. Indemnity

To the maximum extent permitted by law, and except to the extent caused by our own negligence or breach, you indemnify us against any loss, damage, cost or expense we incur arising out of your breach of these terms or your unlawful use of this website.

10. Termination and suspension of access

We may suspend or terminate your access to this website at any time, without notice, if we reasonably consider that you have breached these terms or that suspension is necessary to protect the website or other users. Clauses 4, 7, 8, 9 and 12 survive any termination.

11. Changes to these terms

We may amend these terms from time to time. The version published on this page applies to your use of the website from the date shown at the top of this page. Continuing to use the website after a change means you accept the amended terms.

12. Governing law and jurisdiction

These terms are governed by the laws of the State of Victoria (VIC), Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria (VIC) and of the courts competent to hear appeals from them.

13. Severability and entire agreement

If any provision of these terms is found to be unenforceable, it is severed to the minimum extent necessary and the remaining provisions continue in force. Together with any engagement note between us, these terms record the whole of the agreement between us in relation to this website.
